UK Trademark Registration & Advice on UK Trademark Law
A UK trade mark registration will give you exclusive rights to use your trademark in the UK for those products covered by the registration. Registering a UK trademark will enable you to prevent others from using not only the same trade mark, but also any confusingly similar trademarks in certain circumstances. Only a trademark registration will provide this legal right.
A UK trademark registration:
- may put people off using your trade mark without your permission;
- allows you to take legal action against anyone who uses your trademark in the UK without your permission;
- allows Trading Standards Officers or the police to bring criminal charges against counterfeiters if they use your trade mark in the UK;
- is your property, which means you can sell it, or let other people have a licence that allows them to use it.
The process of obtaining a UK trade mark registration will normally take about 5-6 months, assuming that no serious problems are encountered. UK trade marks will remain valid for 10 years, and can be renewed for further 10-year periods on payment of a renewal fee.
